Arrow Lakeside Resort (“ALR”), is a project being developed by 1115999 Alberta Inc. (the “Company”), an Alberta company that is extraprovincially registered in B.C. The Arrow Lakeside Resort project is a resort condominium property being built in B.C.
British Columbia and Alberta have both enacted similar laws dealing with private sector privacy, known in each province as the Personal Information Protection Act (PIPA). The provincial PIPA’s apply to provincially regulated private sector organizations and set out the ground rules for how B.C. and Alberta businesses and organizations may collect, use and disclose personal information.
As the Company may be collecting and using personal information in both B.C. and Alberta, this memorandum refers to the privacy legislation of both provinces. In addition, this memorandum assumes that the Company is not engaged in commercial activities involving personal information crossing provincial borders (i.e. trans-border flows of personal information in a commercial context). In such a case, the Federal Personal Information Protection and Electronic Documents Act would also apply.
1115999 Alberta Inc., doing business as Arrow Lakeside Resort is committed to respecting and valuing your right to privacy and we want you to feel comfortable about providing us with any personal information. For this reason ALR has a Privacy Policy, set out below, which addresses the principles and practices we follow in protecting your personal information.
For the purposes of this policy, “personal information” means information about an identifiable individual provided by individuals to us. “Non-identifiable information” means information that cannot be associated with or traced back to specific individuals with any certainty.
Collection and Use of Personal Information:
ALR collects personal information from individuals on a voluntary basis through registration requests and transaction documents both online and offline.
The personal information that ALR may collect includes contact information (for example, name, home mailing address, e-mail address and home telephone number), demographic information (for example; gender and occupation), and personal preferences, such as preference with respect to ownership options, rental options etc.
ALR will only use the personal information to respond to your requests for information about our resort and amenities, to communicate with you and as otherwise reasonably required to provide services and products and to market our resort and amenities.
Individuals have the right to (1) access their personal information under ALR’s custody and control, (2) request that ALR correct any errors or omissions in the individual’s personal information. If ALR uses an individual’s personal information to make a decision that directly affects that individual, that information must be retained for at least one year so that the individual has a reasonable opportunity to request access to it.
Disclosure of Information
ALR does not sell, rent, trade or disseminate personal information to non-affiliated persons, other than real estate agents we work with and sales people marketing our development, except with appropriate permission or under the following circumstances:
- to meet legal or regulatory requirements,
- to establish or exercise our legal rights or defend against legal claims,
- upon ALR being acquired by or merged with another company; or
- in connection with the performance or enforcement of contractual obligations.
Retention of Personal Information
We will retain your personal information only as long as necessary to fulfill a legal of business purpose. At such time as personal information is no longer required, information will be made anonymous or destroyed.
Collection, Use and Disclosure of Non-identifiable Information
ALR collects and uses non-identifiable information to assess the effectiveness of website traffic and content. This allows us to improve the quality of visits to our webpage by streamlining the ability to navigate through each section or category. Aggregate non-identifiable information is used to perform statistical analyses of the collective characteristics and behavior of individuals, as well as measure demographics and interest.
Websites Operated by Third Parties
Websites operated by ALR contain links to other websites that may collect personal information. This Policy does not extend to the data collection, disclosure, use and retention practices of such third parties and ALR does not assume any responsibility for the privacy practices, policies or actions of such third parties. Individuals should read the privacy policies of such third parties, and make an informed decision whether or not to visit such web sites and/or provide personal information to such third parties based upon their privacy practices and individual discretion.
